Illinois Automotive Repair Act and Consumer Protections

Amy Bartel • November 4, 2026

Few things are more frustrating than picking up your car and finding a bill much higher than you expected. Illinois lawmakers addressed that problem through the Automotive Repair Act, which sets rules for how repair shops handle estimates, approvals, and invoices.

Combined with the state’s broader consumer protection laws, it gives Oswego and Kendall County drivers clear rights when their vehicles go in for service. Knowing those rights helps you ask the right questions and spot a shop that values transparency.

What the Illinois Automotive Repair Act Covers

The Automotive Repair Act, found at 815 ILCS 306, governs how motor vehicle repair facilities deal with consumers. Its focus is simple: drivers should know what work will be done and what it will cost before they’re committed to paying.

The Act addresses written estimates, customer authorization for additional work, itemized invoices, and the return of replaced parts. It also requires repair facilities to inform customers of their rights under the law.

The full text of the Illinois Automotive Repair Act is available for drivers who want to read the specific requirements, including the dollar thresholds that trigger them.

Your Right to a Written Estimate

One of the Act’s most important protections is the written estimate. For repairs above the dollar amount set in the Act, a repair facility generally must give you a written estimate of the cost of parts and labor before beginning work, unless you choose to waive that right in writing.

The estimate protects you from surprises. Once you approve it, the shop generally cannot charge significantly more than the estimated amount without first getting your consent. Repairs often uncover new problems, such as a worn brake caliper discovered during a pad replacement or a failing sensor found during diagnostics.

When that happens, a shop following the law should contact you, explain what it found, and get your approval before adding to the bill. If you’re asked to sign a waiver of your right to an estimate, read it carefully. Waiving the estimate may make sense for small jobs, but for larger repairs, a written estimate gives you a clear record of what you agreed to.

Itemized Invoices and Replaced Parts

When the work is finished, you have the right to a clear accounting of what was done. Repair facilities must provide an invoice that describes the work performed and itemizes parts and labor, so you can see exactly where your money went.

You can also ask for the parts that were replaced.

Seeing the worn brake pads or the failed component gives you confidence that the work was necessary and actually performed. Some parts may be exceptions, such as those returned to a manufacturer under a warranty or exchange program, so ask about this when you authorize the repair rather than after the job is complete.

How Broader Illinois Consumer Protection Law Helps

The Automotive Repair Act works alongside Illinois’s general consumer protection law. The Illinois Consumer Fraud and Deceptive Business Practices Act prohibits unfair and deceptive practices in consumer transactions, including misrepresenting the condition of a vehicle or charging for work that wasn’t done.

If you have a dispute with a repair shop that you can’t resolve directly, the Illinois Attorney General’s Consumer Protection Division accepts consumer complaints and can help mediate disputes.

Federal guidance is useful too. The FTC’s auto repair basics offers practical tips for choosing a shop, understanding estimates, and protecting yourself from common repair scams.

Questions Oswego Drivers Can Ask Before Authorizing Repairs

These questions help you use your rights and choose a shop you can trust:

  • Will you receive a written estimate for parts and labor before any work begins?
  • How will the shop contact you if it finds additional problems, and will it wait for your approval?
  • Will the final invoice itemize parts and labor separately?
  • Can you have your replaced parts returned, and should you request that now?
  • Are the technicians working on your vehicle ASE certified, and what warranty covers the repair?

A shop that answers these questions openly is giving you the transparency the Automotive Repair Act was designed to encourage.
